To ensure the security, integrity, reliability, and confidentiality of the LIGHTLAYER network and the services provided to its customers, the LIGHTLAYER Abuse Team will manage, notify, and handle violations in accordance with this policy. Based on the nature and severity of the violation, LIGHTLAYER will implement a progressive penalty and enforcement mechanism.
I. Penalty and Enforcement Mechanism
1. Attacks and Security-Related Complaints
(Including but not limited to: launching attacks, port scanning, malicious traffic, illegal intrusion, phishing links, etc.)
a. First Complaint: Immediate suspension of the server. The user must promptly rectify the issue (e.g., system reinstallation, malware removal) and pay a penalty of USD 20 per incident per IP;
b. Second Complaint: Immediate suspension of the server without refund, and a penalty of USD 20 per incident per IP;
c. Three Complaints in Total: LIGHTLAYER reserves the right to permanently terminate and reclaim the server without refund.
2. Infringement Complaints
(Including but not limited to: brand infringement, film and television content, intellectual property rights)
a. First Complaint: The user must promptly remove the infringing content and pay a penalty of USD 20 per incident per IP;
b. Second Complaint: Immediate suspension of the server without refund, and a penalty of USD 20 per incident per IP;
c. Three Complaints in Total: LIGHTLAYER reserves the right to permanently terminate and reclaim the server without refund.
3. Spam Complaints
(Including complaints from Spamhaus or network operators’ anti-spam organizations)
a. First Complaint: Immediate suspension of the server. The user must promptly take corrective measures (e.g., unbinding the reported domain, ceasing spam activities) and pay a penalty of USD 50 per incident per IP;
b. Second Complaint: Immediate suspension of the server without refund, and a penalty of USD 50 per incident per IP;
c. Three Complaints in Total: LIGHTLAYER reserves the right to permanently terminate and reclaim the server without refund.
**Special Note: Any IP reported for spamming will be permanently blocked and not reinstated.
4. Phishing, Fraud, and Illegal Activities
a. First Complaint: Immediate suspension of the server. The user must rectify the issue and pay a penalty of USD 20 per incident per IP;
b. Second Complaint: Immediate suspension of the server without refund, and a penalty of USD 20 per incident per IP;
c. Three Complaints in Total or Severe Violations: LIGHTLAYER reserves the right to immediately terminate and reclaim the server without refund.
**Special Note: LIGHTLAYER reserves the right and obligation to cooperate with judicial investigations.
5. IP Restrictions Due to User Behavior
If an IP address is blocked, flagged as high-risk, or subject to risk warnings due to user activities, LIGHTLAYER does not provide IP replacement services.
6. Cloud Instances
If any abuse complaint is received regarding a cloud instance, the server will be immediately suspended without refund.
II. Notification and Response Time
1. LIGHTLAYER will notify users of complaints via ticket and email.
2. Users must respond and take corrective action within 6 hours. If unresolved within 24 hours, LIGHTLAYER reserves the right to suspend the server without refund.
3. If penalties are not paid within 24 hours, LIGHTLAYER reserves the right to shut down and remove the affected server.
III. Server Reclamation and Refund Policy
1. Servers subject to abuse complaints are not eligible for early termination or refund during the complaint process.
2. If the user refuses to take corrective action, LIGHTLAYER reserves the right to immediately reclaim the server without refund.
3. If the same server accumulates three abuse complaints, LIGHTLAYER reserves the right to permanently reclaim the server without refund.
IV. Policy Amendments
LIGHTLAYER reserves the right to amend this Abuse Complaint and Penalty Policy at any time. Updates will take effect immediately upon revision, with the latest effective date displayed at the bottom of the policy.
Users are strongly encouraged to review this policy regularly. Continued use of LIGHTLAYER services constitutes acknowledgment and acceptance of the most recent version.
